The Devil is in the Details

Listed below are some of the regulations/laws inside the Obama Healthcare Bill that are not widely known and which adds to why this is a very bad bill that will hurt us all!

I’m sure there are many others. I strongly recommend that you read each one as the “devil is in the details.”

If you don’t believe me then I have included the site where you can download the actual Healthcare Bill for reference:

To add insult to injury, Congress has exempted themselves from the bill!

But most of all, remember that this is a Democrat bill.

Here they are:

Pg 22 of the HC bill MANDATES the Government will audit books of ALL EMPLOYERS that self insure!!

Pg 29 lines 4-16 in the HC bill – YOUR HEALTHCARE IS RATIONED!!!

Pg 30 Sec 123 of HC bill – THERE WILL BE A GOVT COMMITTEE that decides what treatments/benefits you get.

Pg 42 of HC bill – The Health Choices Commissioner will choose your HC Benefits for you. You have no choice!

PG 50 Section 152 in HC bill – HC will be provided to ALL non US citizens, illegal or otherwise.

Pg 58HC bill – government will have real-time access to individuals finances & a National ID Healthcard will be issued!

Pg 59 HC bill – lines 21-24 government will have direct access to your banks accounts for electronic funds transfer.

PG 65 Sec 164 is a subsidized plan for retirees and their families in Unions & community organizations (ACORN).

Pg 72 Lines 8-14 government is creating an HC Exchange to bring private HC plans under government control.

PG 84 Sec 203 HC bill – government mandates ALL benefit packages for private HC plans in the Exchange.

Pg 95 HC bill Lines 8-18 The government will use groups i.e., ACORN & Americorps to sign up individuals for government HC plan.

PG 102 Lines 12-18 HC bill – Medicaid Eligible Individuals will be automatically enrolled in Medicaid. No choice.

pg 124 lines 24-25 HC No company can sue GOVT on price fixing.

Pg 145 Line 15-17 An Employer MUST auto enroll employees into public option plan. NO CHOICE.

Pg 146 Lines 22-25 Employers MUST pay for HC for part time employees AND their families.

Pg 149 Lines 16-24 ANY Employer with payroll 400k & above who does not provide public option pays 8% tax on all payroll.

pg 150 Lines 9-13 Businesses with payroll between 251k & 400k who don’t provide public option pays 2-6% tax on all payroll.

Pg 167 Lines 18-23 ANY individual who doesn’t have acceptable HC according to government will be taxed 2.5% of income.

Pg 170 Lines 1-3 Any NONRESIDENT Alien is exempt from individual taxes.

Pg 195 HC bill – Officers and employees of HC Administration will have access individuals finance, papers and records.

PG 203 Line 14-15 HC – “The tax imposed under this section shall not be treated as tax” Yes, it says that.

PG 253 Line 10-18 government sets value of Dr’s time, professional judgement, etc.

PG 265 Sec 1131 government mandates & controls productivity for private HC industries.

PG 268 Sec 1141 Fed government regulates rental & purchase of power driven wheelchairs.

Page 280 Sec 1151 The government will penalize hospitals for what government deems preventable readmissions.

Pg 298 Lines 9-11 Doctors who treat a patient during initial admission that results in a readmission will be penalized.

Pg 317 L 13-20 government will determine what Drs. and how much ownership/investment they can own.

Pg 317-318 lines 21-25, 1-3 government is mandating hospitals cannot expand pg 321 2-13 Hospitals have option to apply for exception but community input required.

Pg335 L 16-25 Pg 336-339 – government sets and mandates establishment of outcome based measures the way they want.

Pg 341 Lines 3-9 government has authority to disqualify Medicare Adv Plans, HMOs, etc.

Pg 354 Sec 1177 – government will RESTRICT enrollment of Special needs patients!

PG 425 Lines 4-12 government mandates Advance Care Planning Consultation- Senior Citizens end of life.

Pg 425 Lines 17-19 government will instruct & consult regarding living wills, durable powers of atty. Mandatory!

PG 425 Lines 22-25, 426 Lines 1-3 government provides approved list of end of life resources, guiding you in death.

PG 427 Lines 15-24 government mandates program for orders for end of life.

Pg 429 Lines 1-9 An “advance care planning consult” will be used frequently as patients health deteriorates.

PG 429 Lines 10-12 “advance care consultation” may include an ORDER 4 end of life plans.

Pg 429 Lines 13-25 – The govt will specify which Doctors can write an end of life order.

PG 430 Lines 11-15 The government will decide what level of treatment you will have at end of life.

Pg 494-498 government will define covered Mental Health services.

    We have the 37th worst quality of healthcare in the developed world. Conservative estimates are that over 120,000 of you dies each year in America from treatable illness that people in other developed countries don’t die from. Rich, middle class, and poor a like. Insured and uninsured. Men, women, children, and babies. This is what being 37th in quality of healthcare means.

    I know that many of you are angry and frustrated that REPUBLICANS! In congress are dragging their feet and trying to block TRUE healthcare reform. What republicans want is just a taxpayer bailout of the DISGRACEFUL GREED DRIVEN PRIVATE FOR PROFIT health insurance industry, and the DISGRACEFUL GREED DRIVEN PRIVATE FOR PROFIT healthcare industry. A trillion dollar taxpayer funded private health insurance bailout is all you really get without a robust government-run public option available on day one. Co-OP’s ARE NOT A SUBSTITUTE FOR A GOVERNMENT-RUN PUBLIC OPTION. They are a fraud being pushed by the GREED DRIVEN PRIVATE FOR PROFIT health insurance industry that is KILLING YOU!

    YOU CANT HAVE AN INSURANCE MANDATE WITHOUT A ROBUST PUBLIC OPTION. MANDATING PRIVATE FOR PROFIT HEALTH INSURANCE AS YOUR ONLY CHOICE WOULD BE A DISASTER AND UNETHICAL, CORRUPT, AND MORALLY REPUGNANT. AND PROBABLY UNCONSTITUTIONAL AS WELL.

    These industries have been slaughtering you and your loved ones like cattle for decades for profit. Including members of congress and their families. These REPUBLICANS are FOOLS!

    Republicans and their traitorous allies have been trying to make it look like it’s President Obama’s fault for the delays, and foot dragging. But I think you all know better than that. President Obama inherited one of the worst government catastrophes in American history from these REPUBLICANS! And President Obama has done a brilliant job of turning things around, and working his heart out for all of us.

    But Republicans think you are just a bunch of stupid, idiot, cash cows with short memories. Just like they did under the Bush administration when they helped Bush and Cheney rape America and the rest of the World.

    But you don’t have to put up with that. And this is what you can do. The Republicans below will be up for reelection on November 2, 2010. Just a little over 13 months from now. And many of you will be able to vote early. So pick some names and tell their voters that their representatives (by name) are obstructing TRUE healthcare reform. And are sellouts to the insurance and medical lobbyist.

    Ask them to contact their representatives and tell them that they are going to work to throw them out of office on November 2, 2010, if not before by impeachment, or recall elections. Doing this will give you something more to do to make things better in America. And it will make you feel better too.

    There are many resources on the internet that can help you find people to call and contact. For example, many social networking sites can be searched by state, city, or University. Be inventive and creative. I can think of many ways to do this. But be nice. These are your neighbors. And most will want to help.

    I know there are a few democrats that have been trying to obstruct TRUE healthcare reform too. But the main problem is the Bush Republicans. Removing them is the best thing tactically to do. On the other hand. If you can easily replace a democrat obstructionist with a supportive democrat, DO IT!

    You have been AMAZING!!! my people. Don’t loose heart. You knew it wasn’t going to be easy saving the World. :-)

    Oh my, blaming Republicans for the failure of the Obama administration to pass his signature legislation is a tad absurd. Dems have 60 seats in the Senate and a huge majority in the House. Republicans couldn’t stop a united Democrat effort were it not for a harsh reality, the American people are not for it either.

    The study that ranks US health care at 37 gives a huge bias to countries with single payer programs. Truth be told, where do people from foreign countries go when their health care system fails them? The United States of course, 37th must not mean very much then.

    A government run Public option is the last thing that will reform this system that despite its major successes has problems that need addressing. Creating a new massive entitlement that will raise deficit rather than bend costs downward takes an already massive problem and sets it over the cliff.

    This bill’s best hope is that people won’t pay attention to the details. Or for that matter the big picture.

    The best way to Reform Health Care is to get Government and the Courts out of the business. The Medical Insurance Companies will only change if the people who they do Business with change it, that means Local and Federal Governments stay out and the Courts stop taking these ridiculous lawsuits. And remember people, those who want to control your life will do so with a lie, a Law and a piece of paper. Oh and one last thing, Jacksmith is just another DemocRAT who wants to be taken care of, have what you have and doesn’t give a hoot about how he does it. Sounds like the Working Class is working hard enough!.

    He did! Fridays show. He said it while he was yelling so it was really humorous. His point is important though. You cannot expect to be taken seriously ranting and raving at your congressman. You need to be able to intelligently convey your message. Tough, but respectful. Yes, I am angry about thois health care thing in particular, but cool heads must prevail.

    The Healthcare bill controls both of the “people factors” by instituting “PEOPLE CONTROL”. (It also controls the means of health care productivity as well, which is capital resources). Anyone who has charge of YOUR HEALTH treatment and care resources, has control over you. YOU, the laborer – wage and salaried workers – and YOU, the entrepreneur. The latter is thoroughly controlled by controlling his employees, if he has any.

    I will not sign up for Government-Ran healthcare and if this current administration takes away private insurance choices lots of people will live to regret their decision last November.

    What I don’t understand is why it’s so completely necessary for Obama to put our healthcare in the hands of government. Why can’t they just work on fixing the parts of what we currently have right now that need fixing? Why do they have to control it all?

  16. How many here live on, or have ever lived on Food Stamps, Medicare and Medicaid? If you are, or have then you know these programs ARE working and working well. However, @ 77 on a very much needs to be fixed income I pay a HUGE premium for Medicare Supplemental Insurance mostly because the heavily subsidized so-called Medicare Advantage Plans suk – big time. I’m GLAD the President’s proposed plan cuts out those subsidies.

    Of course their lobbyists are screaming foul. Of course the high dollar insurance industry is working hard to stir up opposition to the bill. THEY will be the ONLY ones to benefit if it fails.

    Sure welfare works. But, many have come to learn to depend on that welfare check instead of fighting the good fight to get out of that lifestyle. I think welfare programs should only be used if it’s an emergency and only for the shortest amount of time. Once off the program the idea would be to stay off and stop having children out of wed lock.

    Medicare and Medicaid healthcare programs are flawed. Guess who runs those? Yep, the Government! The healthcare provided to our military, their dependents, and our veterans is flawed too. Guess who runs that one? Yep, the Government!

    If I am happy with the current health plan that our family has why should we be forced by the government to give that up and opt for the Government plan? Why does the Government have to run everyone’s healthcare? I don’t want to talk to a Government official about end-of-life care. It’s none of their business.

    I don’t understand why the Government can’t just try and fix what is flawed about the current system. Furthermore, what is the government going to do about those people that do not want to be on a health plan? Hunt them down and slap them with a fine for being irresponsible? Believe it or not there are smart all-knowing individuals out there that choose not to have a health plan. Each case is different but what’s the government going to do? Be the healthcare police? They can’t even police our borders!?

    Peggy is not happy with me. I got an e-mail from her today. Apparently she is throwing in the towel. She doesn’t want to discuss this topic any more because it’s making her blood pressure rise:

    I’m going to have to end this conversation here to protect my blood pressure. There is nothing a Democrat will ever do in any area that will please you. It’s sad that you can only see one point of view which does not appear to be your own.

    What Peggy doesn’t understand is that this isn’t a “Democrat” vs “Republican” issue. This is an American issue and our Constitution hangs in the balance.

    I really don’t give a rats butt if you are Republican, Democrat, Independent, Libertarian OR from the Green Party. Hands off my Healthcare!

    Furthermore — Government needs to get out of our financial institutions, out of our industries, and out of our healthcare. If they want to fix things they can improve upon the stuff that’s already on the books and tend to those broken promises — like patrol our borders and secure them!

    I don’t mind making improvements to the healthcare that we currently have but I do NOT want my government getting in between what should be between me and my doctor. It’s bad enough the insurance companies do that.

As was said by someone in this morning’s news, and I paraphrase–> “leaving health care completely is like trusting a pyromaniac to prevent fires.”

    I read the ranking system that puts the U.S. 37th. They had 5 criteria and 3 of the criteria (60%) defined “quality care” as how equal it was between rich and poor. That ranking system ranks only how much the economic system redistributes wealth among the population.

    I personally don’t mind if there are super rich people who have much better health care perks than I do, as long as mine is good enough for me. This whole class warfare, rich vs.poor argument is stupid. “Communism ensures everyone is equally poor.”
